To help or not to help?

Do you think it is right to punish people for not offering assistance to someone in danger? Explain.

  2. What would the legal implications of this story be today?
    More specifically, is it a crime to walk by when a person is in a life-endangering situation?
    And what happens if a good Samaritan, in their efforts to offer assistance, accidently causes further injuries?
    Duty to rescue
    Under the law, there has never been a positive duty to rescue another person.
    There has been a reluctance throughout our legal history to enforce positive duties to act in a range of situation – the general theory being that as long as you do not directly inflict harm, you should be allowed to act as you please.
    This means there will only be limited circumstances where a person can be liable – and this will be due to some pre-existing connection such as:
    If you caused the danger or injury;
    If the injury or dangerous situation occurred on your property;
    If you have a duty of care because your position in relation to the person in danger, eg you are their doctor, teacher, employer etc; or
    If you created a duty of care through your actions at the time the person was in danger.
    But when it comes to complete strangers, the law has traditionally placed few obligations.

  4. To help or not to help usually depends on the circumstances of the situation.

    For giving an example, imagine that you are taking a walk and suddenly someone with a gun or any dangerous weapon start an attack.
    Would you reduce him risking your life or run away?
    By common sense you run away. this is a extremely situation.

    But what happens if we see an accident and we don´t give help? According to the law is a crime because you don´t help a person who could die and there is no possibilities or considerably less that the person survive without help.

    so, in my opinion, i think it´s right to punish people if we don´t give help like the last example because despite of doesn´t go with you, you must help the person. You could save his/her life if you call emergencies.

  5. In my opinion I see well that people who deny their help to others in need are punished and more if they are at risk of social exclusion since many people discriminate against others only for this reason.

    Currently I see that there is very little solidarity in the world, you just have to look around almost nobody gives money to people who are in the streets or donate clothes for people who do not have or instead of giving food to social canteens, the throw it away.

    Recently we went with religion to an excursion where they showed us a social canteen and a nursing home where almost all the people who work there are volunteers, thanks to people like you, I still trust in the solidarity of the people.

  6. Nowadays the one who sees a person with an accident or needs help has the obligation to help him because it is something good and something that we all have to do.


    On the one hand, there are people who see other people in need of help and do not give it to them, because these people do not care about their life that is in danger. However, the person who sees the accident may not be able to help him because he is in a hurry or is late to a place.


    On the other hand in my opinion I see it fair to punish with a fine people who help people who suffer an accident, but also if they have a good explanation to give the police does not have to receive the fine or punishment.


    In conclusion, people have an obligation to help people in danger because if it happens to you, you also want them to help you.

  7. We are reaching such a point in society, in which I believe that in a few years the rapists, scammers will be rewarded ... meanwhile prisons will be full of super heroes.
    There are many injustices in society. Together, we have to take action and help everyone who needs us.

    Some people see someone who needs our help but out of pure selfishness, they pass by without even looking at him. I think this should be prohibited by law. It is true that many of us do not have enough knowledge of first aid to help a sick person, but we can accompany him, call the doctors, the police or seek help. One way or another, we can always help.

    We must think that maybe tomorrow we will be the ones who need help. I don't think it's nice to be on the ground, for example, and look like a simple ignored paper. After all, we are all a great group and we must help each other. This is what makes you grow as a person. The reward we should expect is a smile. Money is spent and disappears, but personal satisfaction always endures.

    To conclude, I would like to show my indignation with the law. The fact of turning a blind eye to everyday problems should be penalized. I can’t understand how there can be people so bad, able to ignore the pain of a human being.

  8. I think that we should help people who need help because if we have an accident we would like people to help us.

    All people must learn how to treat a person who has had an accident while the ambulance arrives, that moment can be very important, you can save someone's life, but people do not have to be forced to help people, you can Let people be afraid.

    In conclusion I would help a person who had an accident because I can save his life.

  9. Punishing people for not offering assistance to someone in danger is something really controversial. Several governments in some countries say that it has to be punished but the situation is totally different in other countries where they claim that it cannot be punished.



    From my point of view, you cannot force someone to do an heroic act if he doesn’t really want to do it, I mean, you are free to choose. You are not doing something bad or committing a crime to be punished. The fact is that there is people braver than other but no more.



    Moreover, in case you decide to punish, how are you going to do it? It would be really difficult to judge someone for not offering help, because what about if that person is not mentally healthy? Would you punish him? Or if that person just thought that it was a joke?



    As I see it, you can’t punish someone for that. Moreover, I think that this types of thoughts could be negative to our society because children will get use to helping the others just because if they don’t do it, they will be punished instead of because that is something good and necessary.

  10. Nowadays the topic of if people should punish for not offering assistance to someone in danger is very controversial but in my opinion I think that shouldn't punish.

    For example, when two person are hitting I would run away because they can hit me, so I think that if you take risk your life you don't have offer assistance to anyone because your life is the best you have.

    Moreover, with my experience I can say that I run away of danger so I can't see people in danger and I can't help them so I run away of it.

    In conclusion, I think that anybody can't punish anybody for not offering assistance to someone in danger because It isn't our responsibility of do this, but if I could, I would investigate each case and I would do the fair.

  11. According to some people if someone is indanger and another person who is near does not give help to that person it should be a reason of receive a punishment.


    From a point of view if an old man is near an accident and that person is incapable of offering assistance because of his old age. That person is not guilty because he could not do anything so the old man does not deserve to be punished.


    On the other hand, someone who can help a hurted person and he or she does not do anything despite of that person is dying. I think the person who did not give assistance is guilty of murder and that person is a murderer.


    Apart from that I think it does not have to be punished by law. Because that type of people have not feelings and the prison does not give them that feelings that they need. In conclusion, people like that has already been punished by do not having feelings.

  12. In my opinion I think it is right to punish people for not offering assistance to someone in danger.

    An example where these people should be punished is when these people see a traffic accident and don´t call the ambulance. It costs us nothing to make that call, however, we could save the lives of the injured people.

    Another example may be when we see two people fighting.Obviusly, the people when seeing this situation would run away for fear, but if we run away when we see this situation, we should call the police to resolve the problem.

    In short, in my opinion it is necessary to punish people for not offering assistance to someone in danger because perhaps in the future we might need help from other people.

  15. The ethic, the empathy or to be grateful are values that are inside of each one. On the one hand ,there are people who deliver their live helping people and on the other hand there are people who prefer earn money by killing anyone. So,I think that if we want a better world in which peace and empathy predominated, we must start helping people who are in a difficult situation.

    Helping must be mandatory for each one who can provide the tools and skills to solve it. It is true that our life can be in danger, so in this case we can calle the police instead, but people must not ignorance. The ignorance is one of the worst thing that someone can have.

    Furthermore, if we are the person who need help, we would like that people go to help us. This phenomenon is called empathy and is something that all of us must have. Besides, when we help someone we finally feel good with ourself, and from my point of view this is one of the best feeling that a person could have.


    To sum up, for all of these reasons i think that not helping someone who is in a situation between life or dead must be punish. With little things that everyone can do such as called the police or the ambulance can be determinated for a person.

In the world of today, many humans are willing to take a risk to save another person who needs their help or who is in danger, whereas there are even more people who ignore these types of situations. In fact, most of them finally regret their actions so it seemed to me that this kind of “mental” punish is even more effective than the traditional one.

    Firstly, it is important to bear in mind that people are used to not paying attention to others, so the majority of the population would not have the intention to succor you if you were in danger. I can't help watching people who just pass by and ignore certain situations and being shocked of the cruelty that it is spreaded in our society.

    Because of that, children have a wrong idea of what kindness is. They look up to a fake concept of generosity so we are teaching them to continue giving the cold shoulder to this reality. This really worries me.

    Difinitely, from my point of view, I think that there is no punishement greater than conscience. Actually, I reckon there is no point in punishing someone for not offering assistance to others because it hides this big problem. Let's recognize the true heroes and help us each other.
